OVERVIEW Welcome to MirrorMapper. These Terms of Service (“Terms”) govern your access to and use of our website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”). In these Terms, “MirrorMapper”, “we”, “us”, and “our” refer to MirrorMapper Pty Ltd. MirrorMapper is powered by Shopify, which enables us to provide the Services to you. Please read these Terms carefully. They include important information about your legal rights and address areas such as warranty disclaimers and limitations of liability. By visiting, browsing, interacting with, or purchasing from our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. ACCESS AND ACCOUNT
2. Eligibility. By using the Services, you confirm you are at least the age of majority in your place of residence. If you permit a minor dependent to use the Services on devices you own or control, you are responsible for their use.
3. Information you provide. You may be required to provide information such as your email address, billing, payment, and shipping details. You represent that all information you provide is accurate, current, complete, and that you have the right to provide it.
4. Account security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
5. No transfer. You must not transfer, sell, assign, or license your account to any other person.
6. OUR PRODUCTS AND SERVICES
7. Product listings and images. We aim to display products and services as accurately as possible. However, product appearance (including colour) may vary due to your device and display settings.
8. No guarantee of appearance. To the extent permitted by law, we do not guarantee that product images, colours, or renderings will match the actual product.
9. Changes and availability. Product descriptions, pricing, and availability may change at any time without notice. We may discontinue products and may limit quantities by customer, region, or jurisdiction.

11. Offer to purchase. When you place an order, you are making an offer to purchase. We may accept or reject your order at our discretion.
12. Acceptance and payment. An order is not accepted until we confirm acceptance (including by issuing an order confirmation and/or dispatch notice) and receive cleared payment.
13. Order changes and cancellation. Please review your order carefully before submitting. After acceptance, we may be unable to accommodate changes or cancellations.
14. If we cancel or change an order. If we do not accept, cancel, or modify an order, we will attempt to notify you using the contact details provided at checkout.
15. Returns and refunds. Purchases are subject to our Returns and Refunds Policy.
16. No resale/export. Unless expressly agreed in writing, you represent that purchases are for your own use and not for commercial resale or export.
17. PRICES AND BILLING
18. Pricing. Prices, discounts, and promotions may change without notice. The price charged is the price shown at the time you place your order, as reflected in your confirmation.
19. Extra charges. Unless stated otherwise, prices exclude shipping, handling, duties, customs, and import charges, and may exclude taxes depending on your location.
20. Promotions. Promotional terms may apply to certain offers. If promotional terms conflict with these Terms, the promotional terms will prevail.
21. Billing details. You agree to provide and maintain accurate account, payment, and purchase information, including updating card details and contact information as required.
22. Payment authorisation. You represent and warrant that you are authorised to use the payment method provided and that your payment provider will honour the charges.
23. SHIPPING AND DELIVERY
24. Delivery estimates. Any delivery times are estimates only and not guaranteed.
25. Delays. We are not responsible for delays caused by carriers, customs, or events outside our reasonable control.
26. Risk and title. To the extent permitted by law, risk of loss passes to you once the products are handed to the carrier.
27. INTELLECTUAL PROPERTY
28. Ownership. The Services and all associated content (including trademarks, logos, text, graphics, images, videos, audio, design, layout, and compilation) are owned by MirrorMapper or its licensors and are protected by applicable intellectual property laws.
29. Permitted use. You may use the Services for personal, non-commercial purposes only.
30. Restrictions. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent, except as permitted by law.
31. Trademarks. MirrorMapper names, logos, and branding are trademarks of MirrorMapper. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their respective owners.
32. OPTIONAL TOOLS We may provide access to third-party tools that we do not control. These tools are provided “as is” and “as available”. Your use of such tools is at your own risk, and you should review the third-party provider’s terms before use.
33. THIRD-PARTY LINKS The Services may include links to third-party websites or embedded functionality. We do not control and are not responsible for third-party content, accuracy, policies, or practices. Your use of third-party sites is at your own risk.
34. RELATIONSHIP WITH SHOPIFY MirrorMapper is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with MirrorMapper. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MirrorMapper, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MirrorMapper.
35. PRIVACY Our collection and use of personal information is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify may collect and process personal information to provide and improve the platform and related services. Certain information may also be subject to Shopify’s privacy policies.
36. FEEDBACK If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant MirrorMapper a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial purposes. You represent that you own or have the necessary rights to provide Feedback and that it will not violate any law or third-party rights. We may remove Feedback at our discretion.
37. ERRORS, INACCURACIES, AND OMISSIONS Information on the Services may occasionally contain errors (including pricing errors). We reserve the right to correct errors and to update information or cancel orders where permitted by law, including after an order has been submitted.
38. PROHIBITED USES You may use the Services only for lawful purposes. You must not, directly or indirectly:

• violate laws or regulations;
• infringe intellectual property rights;
• harass, abuse, defame, or harm others;
• transmit misleading information;
• transmit spam or unsolicited promotions;
• impersonate others;
• introduce malware or malicious code;
• scrape, crawl, or attempt to interfere with the security or operation of the Services; or
• collect personal information of others without lawful authority. We may suspend or terminate access if we reasonably believe you have breached these Terms.

1. TERMINATION We may terminate or suspend your access to the Services at any time at our discretion. You remain responsible for all amounts owing up to the date of termination. Sections that by their nature should survive termination will survive, including intellectual property, feedback, disclaimers, limitation of liability, indemnities, and governing law.
2. DISCLAIMER OF WARRANTIES To the maximum extent permitted by law, the Services and all products offered through the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, acceptable quality, fitness for purpose, durability, title, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation of the Services. Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies that cannot be excluded under the Australian Consumer Law or other applicable laws.
3. LIMITATION OF LIABILITY To the maximum extent permitted by law, MirrorMapper (and our directors, officers, employees, contractors, agents, suppliers, and service providers), and Shopify (and its affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, savings, data, or goodwill, arising from or related to your use of the Services or products purchased through the Services. Where liability cannot be excluded under applicable law, our liability is limited to the minimum extent permitted.

INDEMNIFICATION You agree to indemnify and hold harmless MirrorMapper, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, liabilities, claims, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your misuse of the Services.
5. SEVERABILITY If any provision of these Terms is held unlawful or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will remain in full force.
6. WAIVER; ENTIRE AGREEMENT No waiver is effective unless in writing. These Terms and all policies referenced form the entire agreement between you and MirrorMapper regarding the Services and supersede prior agreements or understandings.
7. ASSIGNMENT You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time.
8. GOVERNING LAW These Terms are governed by the laws of Victoria, Australia, and the Commonwealth of Australia, without regard to conflict of laws principles. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
9. HEADINGS Headings are for convenience only and do not affect interpretation.
10. CHANGES TO THESE TERMS We may update these Terms from time to time by posting the updated version on our website and updating the “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
